
The regular semi-monthly meeting of the Board of Supervisors, Hanover Township, Northampton County, Pennsylvania was called to order by Chairman John J. Finnigan, Jr. at the Hanover Township Municipal Building, 3630 Jacksonville Road, Bethlehem, Pennsylvania, 18017 at 7:30 P.M.
Present were Supervisors Colon, Walbert, Salvesen and Diacogiannis, Engineer Birdsall, and Solicitor Broughal. Manager Sterner and Public Works Director Healy were on vacation.
The Pledge of Allegiance was performed.
Upon motion of Mr. Walbert, seconded by Mr. Colon, the Board approved the Agenda.

REPORT
OF THE CHAIRMAN
Mr. Finnigan reported that Mr. Drissel from Hanover Engineering, Yvonne Schoenly, Zoning Officer and himself walked the development north of Hanoverville Road due to some letters we’ve received from residents and it appears that the Developer has not graded lots and/or the major drainage swales according to the plan.
Mr. Finnigan directed the Township Engineer to send a letter to the Developer stating that they need to provide verification of lot grading swales and drainage easement swale elevation cross-sections based on the random walk through of the lots.
Mr. Finnigan provided a packet of Policies relating to the Community Center, Pool or Recreation and stated he will discuss them at the end of the meeting.

PLANNING
& ZONING
Mr. Walbert moved that the Board approve the Conditional Use for the YMCA Adult Day Care located at 3893 Adler Place conditioned upon providing documentation that there will be adequate parking for the use and to notify the Developer of the Board’s action.
It was noted that Mr. Marcus Danweber was present representing YMCA Adult Day Care.

Mr. Emil Kantor from Fitzpatrick, Lentz and Bubba, Mr. Chris Williams from Liberty Property Trust and Mr. Michael Tracy from Vinswanger were present representing Shaker Hills Hospitality Group.
The conditions were discussed regarding the conditions use.
Mr. Walbert moved that the Board approve the Conditional Use for the Shaker Hills Hospitality Group, Inc. with the following conditions as stated on July 26, 2005:
1. The restaurant is to be a single story with a maximum of five thousand four hundred square feet (5,400 sq. ft.). The building height should not exceed thirty-eight feet (38’) for either hotel or restaurant.
2. All truck deliveries to hotel and restaurant are to be from Schoenersville Road and no truck traffic is allowed east of High Point Boulevard on Stoke Park Road. All deliveries shall be from 8 AM to 6 PM Monday through Friday.
3. No outdoor music or loudspeakers are permitted.
4. Lighting may not exceed Township Standards for luminaries or height.
5. Only security lighting on north side of hotel (rear) is permitted between midnight and 6 AM.
6. The hotel is conditionally approved as Limited Service Hotel and the following accessory uses is listed in Ordinance are prohibited:
a. Bar
b. Restaurant
c. Lounge
d. Auditorium
e. Meeting rooms
f. Banquet rooms
7. No offensive odors emanating from either use shall be noticeable at or across the property line. Township is to be furnished with documentation relative to fan/vent maintenance contract on an annual basis.
8. The hours of operation for the restaurant are Sunday through Thursday 11 AM to 10 PM and Friday and Saturday 11 AM to 12 midnight unless it is a restaurant that serves breakfast, lunch and dinner then the maximum hours of operation would be 6 AM to 9 PM.
9. At a minimum, the exterior of the ends of the building and 1/3 of front and back elevations must be constructed of brick.
10. Hotel front desk must be physically manned 24 hours a day/7 days a week.
11. All parking spaces must be located outside the twenty-foot (20’) setback.
12. If the hotel contains a pool, the pool shall be provided with a security fence.
13. A landscaping buffer along the north and east property line shall be provided above and beyond but reasonably consistent with the Landscaping Plans approved for the development and the Township Ordinance to the satisfaction of the Planning Commission and Board of Supervisors.
14. The hotel must have recording security/video cameras covering the exterior of the building on a 24 hour/7 days a week basis and the recordings must be maintained for a minimum of sixty (60) days.

ADMINISTRATION
Mr.
Diacogiannis moved that the board approve to accept the proposal from ACE
Imaging Systems for the DocStar System at a State Contract price of $22,117.00
plus $1,800.00 for the support agreement. Also to notify ACE Imaging Systems of
the Board’s decision.
Mr.
Salvesen seconded the motion.
Mr.
Salvesen stated the terms and conditions should be reviewed by the Solicitor
before we sign them.
Mr.
Diacogiannis amended the motion subject to approval of the terms and conditions
agreement per the Solicitor.
Mr.
Walbert seconded the amendment.
Mr.
Finnigan stated he went to two other municipalities; Swatara Township and Upper
Macungie Township to see what they were using. Swatara Township is using
something else and it not user friendly. Upper Macungie Township is using
DocStar in their Sewer Department.
Mr.
Finnigan briefed the Board on the DocStar System.
A
discussion was held on the screen size and to go with a larger widescreen type.
Mr.
Finnigan stated we could approve it subject to the approval from the Solicitor,
which we have, and authorize Township Manager and Secretary to discuss the
proposal with a larger widescreen.

Broughal stated he has the Agreements for Hindu Temple to be signed.

Covenant for Maintenance of Stormwater Management Facilities for Hindu Temple
Addition.

ENGINEER’S REPORT
Mr.
Birdsall reported on the following:

Hindu Temple plans are
ready for signature.

Discussed letter from
Mr. Ravelle on Rosewood Drive. His property abuts the Bethlehem Golf Course and
he is asking for Township assistance regarding a sinkhole problem on golf
course property. Mr. Birdsall suggested responding to the City since this is
not on Township property and asking the City and the Dewire Development to work
together outside of the scope of development to fix the sinkhole situation. Mr.
Finnigan directed the Engineer to respond to Mr. Ravelle’s letter with a copy
to the Mayor of the City of Bethlehem.

Discussed the
construction on Macada Road at Hanover Pointe.

Discussed the
Faulkner/Subaru proposal for signs that is on the Zoning Hearing meeting
agenda.
Mr.
Finnigan discussed the correspondence from the Link family in Monocacy Farms.
We looked at the property when we walked through the development earlier today
and if get assurance from the Developer and Mr. Link that the property is
graded appropriately that the fence would be no problem in the swale and as
long as the pool and deck is not within an easement, we would have no problem
with the hold harmless agreement.
Mr.
Finnigan directed the Township Engineer to send a letter to Mr. Link explaining
the Township’s position and also that it is subject to verification from the
Developer that this grading has been done according to plan.
ROAD REPORTS
Mr.
Walbert – Road District #1 had nothing to report on the road district but
reported on the Colonial Regional Police and the seminar being held in
Melbourne Florida regarding planning, designing and construction a police
facility and that anyone from the municipalities is invited to attend.
Mr.
Salvesen – Road District #2, Mr. Diacogiannis – Road District #3, Mr. Colon –
Road District #4 and Mr. Finnigan – Road District #5 & 6 had nothing to
report.

Finnigan stated he and Cathy went over all the policies.
Mr.
Finnigan discussed all the Policies in the packet presented to the Board.

Membership for HTCC Required for Usage
It shall be the policy of Board of Supervisors, Hanover Township – Northampton County, that all residents and non-residents who desire usage of the Community Center must first purchase a membership (basic or fitness) to the facility.

Use of
Community Center Meeting Room
Use of the meeting room(s) in the Community Center shall be on a rental basis at the following rates:
¼ of the room $35.00; ½ the room $50.00 and the entire room $75.00.
A $50.00 deposit for cleanup is required. Refunded if the room is left clean and in a satisfactory condition.
Dates and items of scheduled meetings are to be arranged with the Recreation Director or their designee to avoid conflicts.

Exception to this policy applies only if a program or class is cancelled by the Community Center or Recreation Department.

Membership
Specials/Marketing Specials
It shall be the policy of the Board of Supervisors, Hanover Township – Northampton County that from time to time specials will be offered to promote memberships and programs at the Community Center and in the Recreation Department. These specials are used to increase membership and program registration.
Specials and/or discounts cannot be applied retroactively to membership or programs.
Coupons or discounts (when required) must be presented at the time of purchase.

Official
Requests for Rentals
It shall be the policy of Board of Supervisors that all official requests for rentals will be received as follows:
Permits for Fall/Winter dates will be accepted starting July 1st
Permits for Spring/Summer dates will be accepted starting January 1st
Any requests received prior to these dates will be rejected and returned.
Other rentals – A minimum of seven (7) days prior to the scheduled event.
Hanover Township programs, Hanover Township organizations and renewals, will take precedence in scheduling.
Dates are subject to change based on Hanover Township events or maintenance.

Gym Rentals
It shall be the policy of the Board
of Supervisors, Hanover Township –Northampton County that:
1. Gym rentals
will require the following before an application for rental can be approved:
a. Gym rentals
will require a $100 security deposit to be applied to the end of the contract
dates. The security deposit will be applied to the final balance
provided no damages or other incidents have resulted as a result of the
rental.
b. A valid
Certificate of Insurance with Hanover Township – Northampton County
listed as an additional insured under their policy for the time of rental,
subject to the satisfaction of the Township Solicitor.
c. A list of
requested dates for the gym use.
2. The
following rental prices will be effective July 1, 2006
a. Weekday
rates – full gym for 1 hour - $60 per hour; half gym for 1 hour - $40 per hour
b. Weekend
rates (Saturday & Sunday) – full gym for 1 hour - $80 per hour; half gym
for 1 hour - $60 per hour
c. Extended
hours – (requires additional hours of operation and staffing): full gym for 1
hour - $80 per hour; half gym for 1 hour - $60 per hour; plus a $25.00 per hour
overtime attendant hourly fee.
3. All
approved gym rental requests must sign an agreement of terms with Hanover
Township.
4. All
approved renters will be required to abide by all Hanover Township Policies and
Procedures and sign the form.
5. Refund
