REGULAR SEMI-MONTHLY MEETING
July 26, 2005

 

The regular semi-monthly meeting of the Board of Supervisors, Hanover Township, Northampton County, Pennsylvania was called to order by Chairman John J. Finnigan, Jr. at the Hanover Township Municipal Building, 3630 Jacksonville Road, Bethlehem, Pennsylvania, 18017 at 7:30 P.M.

Present were Supervisors Colon, Walbert, Salvesen and Diacogiannis, Engineer Birdsall, and Solicitor Broughal. Manager Sterner and Public Works Director Healy were on vacation.

The Pledge of Allegiance was performed.

Upon motion of Mr. Walbert, seconded by Mr. Colon, the Board approved the Agenda.

Upon motion of Mr. Walbert, seconded by Mr. Colon, the Board approved the minutes, as written, from the meeting of the Board of Supervisors dated July 12, 2005.

Upon motion of Mr. Diacogiannis, seconded by Mr. Salvesen, the Board approved the List of Bills and Transfers dated July 26, 2005 as prepared by the Secretary/Treasurer, and to enter the signed List of Bills by the Secretary/Treasurer and the Board of Supervisors as an attachment to the minutes.

REPORT OF THE CHAIRMAN

Mr. Finnigan reported that Mr. Drissel from Hanover Engineering, Yvonne Schoenly, Zoning Officer and himself walked the development north of Hanoverville Road due to some letters we’ve received from residents and it appears that the Developer has not graded lots and/or the major drainage swales according to the plan.

Mr. Finnigan directed the Township Engineer to send a letter to the Developer stating that they need to provide verification of lot grading swales and drainage easement swale elevation cross-sections based on the random walk through of the lots.

Mr. Finnigan provided a packet of Policies relating to the Community Center, Pool or Recreation and stated he will discuss them at the end of the meeting.

Mr. Diacogiannis had nothing to report.

 

SUPERVISORS COMMENTS

It was noted for the record that no one had any comments.

PLANNING & ZONING

Mr. Walbert moved that the Board approve the Conditional Use for the YMCA Adult Day Care located at 3893 Adler Place conditioned upon providing documentation that there will be adequate parking for the use and to notify the Developer of the Board’s action.

It was noted that Mr. Marcus Danweber was present representing YMCA Adult Day Care.

Mr. Emil Kantor from Fitzpatrick, Lentz and Bubba, Mr. Chris Williams from Liberty Property Trust and Mr. Michael Tracy from Vinswanger were present representing Shaker Hills Hospitality Group.

The conditions were discussed regarding the conditions use.

Mr. Walbert moved that the Board approve the Conditional Use for the Shaker Hills Hospitality Group, Inc. with the following conditions as stated on July 26, 2005:

1.                  The restaurant is to be a single story with a maximum of five thousand four hundred square feet (5,400 sq. ft.). The building height should not exceed thirty-eight feet (38’) for either hotel or restaurant.

2.                  All truck deliveries to hotel and restaurant are to be from Schoenersville Road and no truck traffic is allowed east of High Point Boulevard on Stoke Park Road. All deliveries shall be from 8 AM to 6 PM Monday through Friday.

3.                  No outdoor music or loudspeakers are permitted.

4.                  Lighting may not exceed Township Standards for luminaries or height.

5.                  Only security lighting on north side of hotel (rear) is permitted between midnight and 6 AM.

6.                  The hotel is conditionally approved as Limited Service Hotel and the following accessory uses is listed in Ordinance are prohibited:

a.       Bar

b.      Restaurant

c.       Lounge

d.      Auditorium

e.       Meeting rooms

f.        Banquet rooms

7.                  No offensive odors emanating from either use shall be noticeable at or across the property line. Township is to be furnished with documentation relative to fan/vent maintenance contract on an annual basis.

8.                  The hours of operation for the restaurant are Sunday through Thursday 11 AM to 10 PM and Friday and Saturday 11 AM to 12 midnight unless it is a restaurant that serves breakfast, lunch and dinner then the maximum hours of operation would be 6 AM to 9 PM.

9.                  At a minimum, the exterior of the ends of the building and 1/3 of front and back elevations must be constructed of brick.

10.              Hotel front desk must be physically manned 24 hours a day/7 days a week.

11.              All parking spaces must be located outside the twenty-foot (20’) setback.

12.              If the hotel contains a pool, the pool shall be provided with a security fence.

13.              A landscaping buffer along the north and east property line shall be provided above and beyond but reasonably consistent with the Landscaping Plans approved for the development and the Township Ordinance to the satisfaction of the Planning Commission and Board of Supervisors.

14.              The hotel must have recording security/video cameras covering the exterior of the building on a 24 hour/7 days a week basis and the recordings must be maintained for a minimum of sixty (60) days.

            Mr. Walbert moved that the Board approve to amend the Township Zoning Map to change a portion of the Township from R1-S to LBD. Also to authorize the Chairman and Assistant Secretary to sign Ordinance 05-08.

 

ORDINANCE 05-08

AN ORDINANCE ENACTED BY THE BOARD OF SUPERVISORS OF HANOVER TOWNSHIP, NORTHAMPTON COUNTY, PENNSYLVANIA, ENACTING CERTAIN AMENDMENTS TO THE “HANOVER TOWNSHIP ZONING ORDINANCE” AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT HEREWITH

            Mr. Colon seconded the motion.

            Mr. Walbert moved that the Board approve to amend the Township Zoning Ordinance to change a certain portion of the Township from R1-S to LBD. Also to authorize the Chairman and Assistant Secretary to sign Ordinance 05-09.

 

ORDINANCE 05-09

 

AN ORDINANCE ENACTED BY THE BOARD OF SUPERVISORS OF HANOVER TOWNSHIP, NORTHAMPTON COUNTY, PENNSYLVANIA, ENACTING CERTAIN AMENDMENTS TO THE “HANOVER TOWNSHIP ZONING ORDINANCE” AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT HEREWITH

            Mr. Colon seconded the motion.

ADMINISTRATION

            Mr. Diacogiannis moved that the board approve to accept the proposal from ACE Imaging Systems for the DocStar System at a State Contract price of $22,117.00 plus $1,800.00 for the support agreement. Also to notify ACE Imaging Systems of the Board’s decision.

            Mr. Salvesen seconded the motion.

            Mr. Salvesen stated the terms and conditions should be reviewed by the Solicitor before we sign them.

            Mr. Diacogiannis amended the motion subject to approval of the terms and conditions agreement per the Solicitor.

            Mr. Walbert seconded the amendment.

            Mr. Finnigan stated he went to two other municipalities; Swatara Township and Upper Macungie Township to see what they were using. Swatara Township is using something else and it not user friendly. Upper Macungie Township is using DocStar in their Sewer Department.

            Mr. Finnigan briefed the Board on the DocStar System.

            A discussion was held on the screen size and to go with a larger widescreen type.

            Mr. Finnigan stated we could approve it subject to the approval from the Solicitor, which we have, and authorize Township Manager and Secretary to discuss the proposal with a larger widescreen.

            Mr. Diacogiannis moved that the Board approve the proposal dated June 28, 2005 from Linda Sterner for Tax Collection for the year 2006 at a cost of $15,000.00 per year paid monthly, subject to confirmation of her election in the November 2005 Election as Tax Collector.

SOLICITOR’S REPORT

            Mr. Broughal stated he has the Agreements for Hindu Temple to be signed.

            Mr. Colon moved that the Board approve to authorize the Chairman and Secretary to sign the Improvements Agreements, Maintenance Agreements and the Declaration of Covenant for Maintenance of Stormwater Management Facilities for Hindu Temple Addition.

            Mr. Walbert seconded the motion.

ENGINEER’S REPORT

            Mr. Birdsall reported on the following:

-         Hindu Temple plans are ready for signature.

-         Discussed letter from Mr. Ravelle on Rosewood Drive. His property abuts the Bethlehem Golf Course and he is asking for Township assistance regarding a sinkhole problem on golf course property. Mr. Birdsall suggested responding to the City since this is not on Township property and asking the City and the Dewire Development to work together outside of the scope of development to fix the sinkhole situation. Mr. Finnigan directed the Engineer to respond to Mr. Ravelle’s letter with a copy to the Mayor of the City of Bethlehem.

-         Discussed the construction on Macada Road at Hanover Pointe.

-         Discussed the Faulkner/Subaru proposal for signs that is on the Zoning Hearing meeting agenda.

 

            Mr. Finnigan discussed the correspondence from the Link family in Monocacy Farms. We looked at the property when we walked through the development earlier today and if get assurance from the Developer and Mr. Link that the property is graded appropriately that the fence would be no problem in the swale and as long as the pool and deck is not within an easement, we would have no problem with the hold harmless agreement.

            Mr. Finnigan directed the Township Engineer to send a letter to Mr. Link explaining the Township’s position and also that it is subject to verification from the Developer that this grading has been done according to plan.

 

ROAD REPORTS

            Mr. Walbert – Road District #1 had nothing to report on the road district but reported on the Colonial Regional Police and the seminar being held in Melbourne Florida regarding planning, designing and construction a police facility and that anyone from the municipalities is invited to attend.

            Mr. Salvesen – Road District #2, Mr. Diacogiannis – Road District #3, Mr. Colon – Road District #4 and Mr. Finnigan – Road District #5 & 6 had nothing to report.

 

            Mr. Finnigan stated he and Cathy went over all the policies.

            Mr. Finnigan discussed all the Policies in the packet presented to the Board.

            Mr. Finnigan moved that the Board approve the following amended and rescinded policies as presented during the meeting as follows:

Policy 43

Basic Membership for HTCC Required for Usage

 

It shall be the policy of Board of Supervisors, Hanover Township – Northampton County, that all residents and non-residents who desire usage of the Community Center must first purchase a membership (basic or fitness) to the facility.

Policy 43-3

Use of Community Center Meeting Room

 

Use of the meeting room(s) in the Community Center shall be on a rental basis at the following rates:

 

¼ of the room $35.00; ½ the room $50.00 and the entire room $75.00.

 

A $50.00 deposit for cleanup is required.   Refunded if the room is left clean and in a satisfactory condition.

 

Dates and items of scheduled meetings are to be arranged with the Recreation Director or their designee to avoid conflicts.

Policy 43-4

Membership Refund

 

It shall be the policy of the Hanover Township Community Center to refund the balance of any membership of those members that relocate outside the Township.

 

 

(Please note that the Township Manager does not agree with this Policy.  Policy 43-2 states that memberships are not refundable.)

Policy 43-5

Refund Policy for Recreation Department

 

It shall be the policy of the Board of Supervisors, Hanover Township – Northampton County that the Community Center and Recreation Department abide by the following:

 

Registrations and/or fess are non-transferable and non-refundable.

 

Exception to this policy applies only if a program or class is cancelled by the Community Center or Recreation Department.

Policy 43-6

Membership Specials/Marketing Specials

 

It shall be the policy of the Board of Supervisors, Hanover Township – Northampton County that from time to time specials will be offered to promote memberships and programs at the Community Center and in the Recreation Department.   These specials are used to increase membership and program registration. 

 

Specials and/or discounts cannot be applied retroactively to membership or programs.  

 

Coupons or discounts (when required) must be presented at the time of purchase.

Policy 43-7

Membership Renewal Rate

 

It shall be the policy of the Board of Supervisors, Hanover Township – Northampton County that Hanover Township Community Center Memberships have a renewal rate which entitles members to renew at their old rates as long as they renew within 30 days of their membership agreement.

Policy 43-8

Membership Agreement

 

It shall be the policy of the Board of Supervisors, Hanover Township – Northampton County that memberships at the Community Center have a contract or agreement that provides for memberships lasting one (1) month, three (3) months and one (1) year.

Policy 43-9

Official Requests for Rentals

 

It shall be the policy of Board of Supervisors that all official requests for rentals will be received as follows:

 

Permits for Fall/Winter dates will be accepted starting July 1st

Permits for Spring/Summer dates will be accepted starting January 1st

 

Any requests received prior to these dates will be rejected and returned.

 

Other rentals – A minimum of seven (7) days prior to the scheduled event.

 

Hanover Township programs, Hanover Township organizations and renewals, will take precedence in scheduling.

 

Dates are subject to change based on Hanover Township events or maintenance.

Policy  43-10

Gym Rentals

 

It shall be the policy of the Board of Supervisors, Hanover Township –Northampton County that:

 

1.      Gym rentals will require the following before an application for rental can be approved:

a.       Gym rentals will require a $100 security deposit to be applied to the end of the contract dates.   The security deposit will be applied to the final balance provided no damages or other incidents have resulted as a result of the rental.  

b.      A valid Certificate of  Insurance with Hanover Township – Northampton County listed as an additional insured under their policy for the time of rental, subject to the satisfaction of the Township Solicitor.

c.       A list of requested dates for the gym use.

2.      The following rental prices will be effective July 1, 2006

a.       Weekday rates – full gym for 1 hour - $60 per hour; half gym for 1 hour - $40 per hour

b.      Weekend rates (Saturday & Sunday) – full gym for 1 hour - $80 per hour; half gym for 1 hour - $60 per hour

c.       Extended hours – (requires additional hours of operation and staffing): full gym for 1 hour - $80 per hour; half gym for 1 hour - $60 per hour; plus a $25.00 per hour overtime attendant hourly fee.

3.      All approved gym rental requests must sign an agreement of terms with Hanover Township.

4.      All approved renters will be required to abide by all Hanover Township Policies and Procedures and sign the form.

5.      Refund policy for rentals

a.       Cancellation 30 days or more prior to the scheduled date/event - $5.00 service charge

b.      Cancellation 7 or more days prior to the scheduled date/event – 50% of rental fees will be due

c.       Cancellation less than 7 days prior to scheduled date/event – 100% of rental fees will be due

Policy 43-15

Field Rental Policy

 

It shall be the policy of Board of Supervisors that all official requests for rentals of the Township Fields will be as follows:

 

Fields:

Crawford Park Upper

Crawford Park Lower

Municipal Tract Baseball Field

Municipal Tract Softball Field

Municipal Tract Upper Field

Municipal Tract Lower Field

Pharo Park

 

Permits may be requested for Fall/Winter dates starting July 1st

Spring/Summer permits may be requested starting January 1st

All permits are on a first come first serve basis

 

Fall/Winter:               September 1st through February 28th

Spring/Summer:          March 1st through August 30th 

 

Fees:

Soccer/Lacrosse/Football

·        $20 per field/per two hour window (minimum (pro-rate additional time accordingly- 1 hr. $10))

·        $100 per field/all day use

 

Baseball/Softball

·        $25 Permit per season

·        $5 per day per field fee

 

  Any organized team or league use must have a permit for field and the following conditions apply. Permits will be issued at the Community Center: Payment is due immediately, list of dates and Certificate of Insurance listing Hanover Township – Northampton County as an additional insured, satisfactory to the Township Solicitor (minimum of $500,000) must be provided at time of request.

 

Policies and Conditions for all rentals and permits must be signed.

Policies and Conditions

 

  1. Alcoholic beverages or tobacco products of any kind are strictly prohibited in Hanover Township Community Center.
  2. Alcoholic beverages of any kind are strictly prohibited in any Hanover Township Park or at any Field.
  3. Food and drink is NOT permitted in the GYMNASIUM. Please use the designated concession area where food and drinks are sold.
  4. Access to facilities or rooms during your rental time that are NOT otherwise included with the rental agreement is prohibited.  The game room may only be used by members, or you can purchase a daily pass based upon age of customer.
  5. On staff members of the Community Center are in charge of the function.
  6. The Community Center staff members are responsible for setting up tables and chairs unless otherwise notified.  Room set up arrangements must be made five days prior to the event.
  7. Decorations may not be hung on the walls in the meeting room or the gym unless otherwise stated.
  8. Upon completion of the event, the room(s) must be vacated by the designated time. The room must be cleaned and returned to the condition it was rented. If the room is not suitably clean, entire deposit may be forfeited by the Lessee and retained by the Community Center. Any damages that exceed the deposit during the rental will be billed to the Lessee.
  9. Only Community Center staff members may open and close windows and/or doors at the Lessee’s request.
  10. The Community Center will not pull out the bleachers for observers/no chairs in gymnasium.
  11. All participants, coaches, and officials must wear sneakers in the gymnasium.
  12. The Community Center will not be responsible for any injuries, damages, or stolen property that may occur to Lessee or Lessee’s party during any function.
  13. The Community Center reserves the right to eject any person(s) who does not act in accordance with Center and/or Township policies, regulations, rules and ordinances.
  14. A copy of your insurance must be given to Hanover Township Community Center. Certificate of Insurance must list Hanover Township – Northampton County as an additional insured, satisfactory to the Township Solicitor (minimum of $500,000). (Certificate of Insurance applies to Gym and Field Rentals only.)
  15. Monthly Booking charges due on the first day of the previous month prior to that in which the booking(s) will occur.
  16. Due to obligation of the Community Center, times and date may be subject to change.
  17. In case of inclement weather, please listen to the following radio stations for the closing of the center: B104 FM, Oldies 99.9 FM and WLEV 100.7 FM.
  18. Cancellations: 30 days or more before scheduled dates receives a $5 service charge.

Cancellations 7 or more days before scheduled date- 50% of costs will be due.

Cancellations less than 7 days before scheduled date- 100% of costs will be due.

 

 

 

 

 

19. Cancellations due to inclement weather will be handled accordingly:

All efforts will be made to accommodate another date for Lessee as found available at time of cancellation.  No refunds will be issued if a new date can not be agreed upon.

Policy 43-16

Pool Admittance

 

It shall be the policy of the Board of Supervisors Hanover Township – Northampton County that admittance to the pool may be gained by the following means:

 

  1. Annual membership (ID card)
  2. Payment of Daily Fee with Proof of Identity (all individuals over age of 16 must provide proof of identity)
    1. Complete daily Sign in Sheet

            Mr. Finnigan directed the Township Solicitor to review the Policies and Conditions adopted July 26, 2005.

 

            Mr. Finnigan stated we need to have an executive session for personnel issues.

 

            Mr. Finnigan closed the regular meeting at 8:30 P.M. and opened the Executive Session.

 

            The Executive Session concluded at 8:45 P.M.

 

            Upon motion of Mr. Walbert, seconded by Mr. Colon, the Board approved adjournment at 8:45 P.M.
