Minutes of the January 12, 2004 Meeting

 

Meeting #799 of the Hanover Township Northampton County Planning Commission was held at the Hanover Township Municipal Building, 3630 Jacksonville Road, Bethlehem, Pennsylvania, Monday, January 12, 2004, and convened at 7:30 P.M.

 

Planning Commission members in attendance:

REORGANIZATION

On the motion of Kuehne,  seconded by McGonigle, the Planning Commission unanimously approved to re-appoint Mark Tanczos as Chairman and Joseph Hilton as Vice-Chairman.

 

On the motion of Tanczos, seconded by  McGonigle, the Planning Commission unanimously approved to re-appoint Paul Kuehne as Secretary.

 

On the motion of Kuehne, seconded by Tanczos, the Planning Commission unanimously approved to re-appoint Sylvia McLaughlin as Clerk.

On the motion of McGonigle, seconded by Kuehne, the minutes of the December 1, 2003 Planning Commission Meeting were approved as written.

LVCC  PHASE II  LOT 3     Site Plan     Preliminary/Record Plan

Tom Buss (Liberty Engineering)

           

One loading space will be moved back, creating more space for the dumpster.

 

Topsoil will be stored on Lot 4.  Buss advised that they have a verbal agreement with LVCC, owner of Lot 4, allowing this.

 

Planners requested that owner submit a letter with specific information on the type of procedures and materials to be used and stored.  Concerns are whether there will be any hazardous materials, their use and their disposal - Zoning 185-20.C (7) (8) & (9).

 

Motion was made by Tanczos, seconded by Kuehne, to forward letter to the Board of Supervisors recommending Conditional Approval, pending satisfaction of comments made in letter from Hanover Engineering dated January 7, 2004.

JAINDL - IDI    1 LOT   PIBD SUBDIVISION

Hanover Corporate Center I       Preliminary/Record Plan

Scott Pidcock and Bruce Anderson (The Pidcock Company)       David Jaindl (Developer)

 

Proposed plan creates a one-lot subdivision of 37 acres in the PIBD (Lot 3) Zone of the Jaindl     3 Lot Subdivision.

 

Pidcock advised that considering the current and anticipated congestion on Hanoverville Road, developer designed a road network, creating Hanover Corporate Boulevard, originating at Township Line Road through tract to Route 512 with an addition of a jug handle to form a new intersection on Route 512, replacing existing intersection of Hanoverville Road with Route 512.  Developer will deflect a leg of Hanoverville Road west of Route 512 to form new intersection.  Intersection leg of North Commerce Way from proposed Hanover Corporate Boulevard remains.  Road design anticipates traffic from the east, heading west, generated from future development in Lower Nazareth Township.  Existing Hanover Road will terminate in a cul-de-sac at its western end.  Hanoverville Road traffic will be diverted to proposed Hanover Corporate Boulevard.

 

Pidcock informed Planners there will be major improvements on Route 512.  Deferred work on the west side of Route 512 will also be completed.  PennDot Occupancy Permit must be obtained.  Global Traffic Study, which includes background growth factors for all development, including undeveloped properties, was presented to PennDot.  Developer has met with PennDot several times.

 

Planners understand that two warehouses at a total of 1.2 million square feet with 200 plus docking bays for trucks are being proposed in Lower Nazareth Township.

 

 

 

JAINDL - IDI  PIBD SUBDIVISION Continued

Pidcock advised the reason for proposed subdivision is to provide a location for IDI developer, who will build facility for a pharmaceutical firm from Atlanta.  Proposed building would be a very low truck traffic generator proportionate to the building size.  IDI’s intent is to break ground in May of this year.  Pidcock affirms it is impossible to have entire subdivision processed to final approval and recorded in time for the May timetable.  Conveyance is needed for IDI to begin construction.  Completion date is targeted for spring or summer of 2005.  Fit out with conveyors, racking, assembly work, etc. will follow.  Occupancy targeted in 2006.

 

Pidcock stated they want to have to road, as well as highway improvements, completed when pharmaceutical facility opens, also, prior to the occupancy of warehouses in Lower Nazareth Township. 

 

This proposal is in violation of the original Jaindl 3 Lot Subdivision Agreement dated January 19, 2001.  Pidcock advised that their attorney, the Township solicitor, along with the Board of Supervisors must prepare an amendment to governing Agreement.

 

Pidcock advised the Site Plan by IDI will be presented to the Planning Commission at the February meeting.  This proposal will again be reviewed at the February meeting.  Entire subdivision will be forthcoming in March or April.

 

Approval will be requested for the access driveway for this parcel, which will be constructed to collector road standards at 38 feet wide.  In essence, this driveway will become North Commerce Way.  There will be two driveways on the lot for the pharmaceutical facility.  North Commerce Way will align with one driveway and with proper separation another driveway will be located to the west.

 

Developer intends to connect sanitary sewer line to existing pump station along Hanoverville Road.  This would be an interim arrangement for proposed lot, as a new pump station will be built by developer to which it would be connected in the future.

 

Chairman Tanczos stated that proposed use concerns him.  Originally, the use recommended for this PIBD Zone was to be less intense.  This use as a distribution center/warehouse will generate more truck traffic.  There already is such a large percentage of truck traffic on Route 512. 

 

Jaindl advised the anticipated total number of trips per day is 140.  Peak hour numbers will be provided.

      Asked where water line will be located.  He stated Bethlehem Water Authority advised a               water lateral must be provided for him.

      Asked how far from his property line the wall  will be installed.  Location should be                       determined so wall can be maintained without trespassing onto his property. 

         Pidcock advised they can locate the wall in such a position so they do not trespass to                     maintain it.

            Tanczos asked if the wall location will be shown on next submission.

               Response - yes

 

      Sandt stated he cannot use his land in the site triangle (plantings).

         Pidcock stated the positioning of the road is to align it with North Commerce Way to the               south.

         Jaindl advised these discussions were heard with the Board of Supervisors.

 

      Sandt is concerned about right hand turns over his property.

         Jaindl stated this is unlikely especially now since the west end of Hanoverville road will be a           cul-de-sac.

 

      Attached statement was read by Sandt.

 

Chairman Tanczos asked what developer plans for the residual land in the northeast corner since Steuben nor Township Line Road are to be used for access.  Developer advised when decision has been made proposal will be submitted. 

 

Chairman Tanczos reiterated from a Comprehensive Plan viewpoint the Planning Commission recommended to the Board of Supervisors reducing the intensity of what was to be proposed when expanding this PIBD Zone.  Proposal is for a larger building than what was intended.    Proposed use will be addressed at a future meeting

 

ZONING ORDINANCE AMENDMENT

Landscaping requirement change was discussed.

 

Motion was made by Tanczos, seconded by McGonigle, to forward letter recommending Planning approval to the Board of Supervisors.

Laslo Viradi of Macada North asked if anything was received from Stanberry developer.  Concerning a mall, residents are concerned about crime, traffic, environmental concerns, theft, vandalism, unsightliness, etc.

Resident was advised that the land along Route 22 is zoned O&I.  The land near Macada North is zoned PHR.  To allow a shopping mall, land would need to be rezoned.

 

PLANNING

Planner Kuehne offered his comments that Planning information has been received via the newspaper.  Developers going to the Supervisors prior to Planning negates this advisory group.  Planners become handcuffed in their decision making.  Perhaps a Planning Commission member could attend the Supervisor’s meetings and offer comments, as seen fit, reporting back to this Commission.
