Minutes of the May 5, 2003 Meeting

Meeting #792 the Hanover Township Northampton County Planning Commission was held at the Hanover Township Municipal Building, 3630 Jacksonville Road, Bethlehem, Pennsylvania, Monday, May 5, 2000, and convened at 7:30 P.M.

On the motion of McGonigle, seconded by Kuehne, the minutes of the April 14, 2003 Planning Commission Meeting were unanimously approved as written.

LVCC II - LOT 11 Bennigan’s Restaurant Land Development Plan Preliminary/Record Plan

Conditional Use Hearing was held with approval being granted. Landscaping was added.

Comments are pending from the Conservation District and the Township Fire Marshal.

Patio is surrounded by a 4’ high cedar fence with 5’ high brick pillars. An 8’ high fence screens the coolers at the rear of proposed restaurant.

Motion was made by Tanczos, seconded by Kuehne, to approve requested waiver on Noise Protection (S.A.L.D.O. Section 159-25).

Planner McGonigle questioned how late lights would be on. Hours of operation are not certain. Ferretti advised Monday through Thursday it could be 10:00 p.m. And the weekend it would be later per demand. Security lighting would be on through the dark hours.

Motion was made by Tanczos, seconded by McGonigle, to forward letter to the Board of Supervisors recommending Conditional Approval, pending satisfaction of comments outlined in Hanover Engineering’s letter, dated April 24, 2003.

LVIP IV - LOTS 55 and 56 Flavor Right Foods Lot Line Consolidation Plan

Land Development Plan Preliminary/Record Plan

Flavor Right purchased adjacent lot and requests merging Lots 55 and 56.

Proposed is a 23,800 square foot single story warehouse addition which would employ one (1) additional person. Future parking is shown on plan. There will be no need for additional parking. Waiver on parking is requested. There are 22 people employed plus office staff and sales representatives for a total of 32 employees. Facility operates Monday through Thursday. There will be one fork lift but no crane in proposed addition, which will be mainly a freezer. Operation averages eight (8) trailers per day.

Motion was made by Tanczos, seconded by Hilton, to recommend approval of requested waiver of parking requirement.

Motion was made by Tanczos, seconded by Kuehne, to forward letter to the Board of Supervisors recommending Conditional Approval of the Land Development Plan, pending satisfaction of comments made in Hanover Engineering’s letter dated April 25, 2003.

LVCC II - LOT 1 Schoenersville Plaza Land Development Plan Conditional Use Plan

Proposed retail lot is located along Schoenersville Road between WaWa and the Oasis Restaurant

Developer will reduce proposed building by one bay to approximately 10,300 square feet. Single story building will be brick front and back. Roof lines would conceal air conditioning units. There will also be a back door for each unit.

Parking space dimensions will be corrected to 10’ x 18’. Parking calculation is 0.7 per 100 square foot plus one space per employee. Sidewalk must be included to provide safe access from parking at the rear of the building to the front of the building. No Parking Fire Zone must be provided.

.Lot has shared access with WaWa. Driveway at 24’ wide is adequate for emergency vehicles. Driveway off Schoenersville Road is right in/right out. Another access will be removed in order to provide the required number of parking spaces. A 12’ x 40’ space for truck parking is provided.

Offset to the 100 year flood plane will be addressed.

Interested tenants include a pizza shop, a bagel shop, a hair salon and a dry cleaner, however, no leases have been signed. These would be permitted uses. Conditional Use Hearing is scheduled for approval of proposed shopping center. Permitted uses would not require additional Conditional Use Hearings, however, a conditional use (not a permitted use) would require a hearing. Note should be added to plan.

Comments from Fire Marshal are needed.

Hours of operation need to be determined.

Lighting provisions must be shown with designation on what lights will remain on after hours of operation for security reasons.

Proposal is called a Shopping Center for the purpose of parking. Under the Conditional Use Provision, it is a Service Support Area.

Township Ordinance requires that screening be provided when within 300’ of a Residential District. Proposed building is within 120’ of adjacent land owned by the Lehigh Valley International Airport zoned R-1S. A landscaped berm exists along property line. Upon discussion, Planners recommend a deferral of additional landscaping. A note should be added to Plan stipulating that if the Residential tract is developed and homes built, a Landscaping Plan must be submitted to the Township to assure that sufficient and acceptable buffering is being provided.

Motion was made by Tanczos, seconded by Hilton, to recommend Conditional Use approval based upon Planning comments with regards to additional screening, conditional use for non-permitted uses, hours of operation and lighting.

GENERAL

Township resident George Scoggin, a potential candidate to fill the vacancy on the Planning Commission, attended meeting and spoke with Planners.

ENGINEER’S REPORT

Aspen Inn storm drainage project has begun.

PLANNING

Ad hoc committee working on the Comprehensive Plan are Tanczos, Hilton, McGonigle and Taggart.

Motion was made by Kuehne, seconded by Hilton, to endorse George Scoggin for appointment to the Planning Commission. Susan Lawless was also impressive and her resume should be kept on file for the future.
